1.1. The website, operating at www.trainers.org, is operated by the ITFF Institute Foundation, which conducts business and statutory activities on the basis of its entry in the National Court Register under the name “ITFF Institute” Foundation:
1.2. These Regulations specify:
1.2.1. terms and conditions of use of the LMS Trainers.org portal,
1.2.2. Rules for the provision of services electronically by the “ITFF Institute” Foundation under Trainers.org,
1.2.3. Principles of contracting with the Foundation “ITFF Institute”,
1.2.4. Rules for concluding remote agreements between Users and ITFF (ITFF Agreement).
1.3. Each user of Trainers.org shall read these Terms and Conditions before using Trainers.org and shall abide by these Terms and Conditions while using Trainers.org.
1.4. The “ITFF Institute” Foundation makes these Terms and Conditions available to Users free of charge prior to the conclusion of the Agreement through Trainers.org at www.trainers.org, in a form that allows them to download, record and print them.
1.5. The “ITFF Institute” Foundation provides services electronically in accordance with these Regulations.
1.6. These Regulations are the regulations referred to in Art. 8 of the Law on Provision of Electronic Services.
1.7. Trainers.org is a platform providing specialized e-learning and ed-tech solutions that enable Consumers to purchase educational services to present their profile as an expert, their training offerings to potential recipients of such training services through their profile on Trainers.org in order to conclude a Trainer Agreement. Through Trainers.org, Trainers Organization also provides its content, including enabling people to learn about training tools, exercises and methods. The platform allows trainers who have opted for membership to take part in testimonials and set up their own or add training materials.
1.8. Registration or conclusion of a Contract with the “ITFF Institute” Foundation is subject to acceptance of the Terms and Conditions.
1.9. Individuals can independently use Trainers.org if they are at least 18 years old and have full or at least limited legal capacity. Those who are under the age of 18 but are of legal age to use online services in their country (e.g., in the U.S. and Poland it’s 13, and in Ireland it’s 16) cannot create an account, but they can ask a parent or guardian to open an account and help them access content that is appropriate for them. Individuals under the age required to use online services in the country cannot create an account.
1.10. The content of Trainers.org does not constitute an offer or invitation to bargain under civil law.
1.11. Each User is obliged to comply with the prohibition of providing unlawful content.
1.12. Detailed information regarding ITFF’s processing of User information on Trainers.org and the use of cookies can be found in Trainers.org’s Privacy and Cookies Policy, made available at www.trainers.org/polityka-prywatnosci.
Whenever the following terms are used in these Regulations, they shall be understood as such:
ITFF – ITFF Institute Foundation conducting business and statutory activities on the basis of registration in the National Court Register, under NIP: 9820358225, KRS: 0000324772, Regon 100639532, mailing address and business address: Poland, Łódź, ul. Narutowicza 40/1 90-135.
Consumer – a natural person who enters into a contract directly related to his/her business activity, when the content of the contract shows that it does not have a professional character for this person, arising in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.
Account – the User’s individual access to Trainers.org, available after registration and entering a login and password in the space provided.
Fee – a fee for providing access to the Services and/or using certain services provided by ITFF under Trainers.org.
Subscription Fee – an annual fee for the use of certain services provided by ITFF under Trainers.org.
Accreditation Fee – a fee for providing the author’s ITFF accreditation track within Trainers.org.
Regulations – these Regulations for the provision of electronic services by ITFF within Trainers.org.
Registration – the action of creating an Account on Trainers.org.
Trainers.org – a website operating at www.trainers.org.
Trainer – the status of a user on Trainers.org with an Account assigned by the ITFF.
Agreement – an agreement between ITFF and the User, based on which ITFF through Trainers.org provides Users / Trainers electronically with Services.
Agreement with ITFF – an agreement entered into through Trainers.org between the User and ITFF, pursuant to which ITFF undertakes to provide the User with the service made available on Trainers.org and ordered by the User. The conclusion of the contract occurs when the User makes an Order.
Service – a service provided electronically under the terms of these Regulations, in the form of educational services, courses, e-learning materials and related services.
Law on Provision of Electronic Services – the law of July 18, 2002. On provision of services by electronic means (i.e. Journal of Laws of 2020, item 344, as amended).
User – a recipient of services, an entity that is a natural person, legal entity or unincorporated entity that meets the conditions contained in these Regulations and uses the Services provided through Trainers.org.
Order – a statement of will of the User constituting an offer to enter into an Agreement with ITFF, the subject of which is to be the provision by ITFF of services indicated by the User from among the offerings presented on the Trainers.org website.
3.1. In order to properly and fully use Trainers.org, you are required to:
3.1.1. having a computer or other device, along with an installed web browser capable of displaying web pages and with access to the Internet;
3.1.2. having an email address;
4.1. ITFF provides using Trainers.org Services consisting of:
4.1.1. Enabling the conclusion of a Remote Agreement with ITFF for the purchase of Services.
4.1.2. Making freely available on Trainers.org publicly accessible content (articles, information, photos, graphics, data, programs and description of the Services, communications, information on ITFF activities, studies other than the Services, along with the possibility of free reading by Users.
4.1.3. providing free access to the description of the Services in order for Users to purchase access to them.
4.1.4. sharing Trainers.org. Trainers in order to enable them to present themselves and their offer of educational services to potential recipients of training services, along with the possibility of free familiarization by Users.
4.1.5. making the author’s accreditation path available for a fee through ITFF’s Trainers.org.
4.1.6. Free maintenance of User Accounts.
4.1.7. free of charge, periodic delivery of newsletters (information about ITFF activities and commercial information) to Users, to the e-mail address provided by them.
5.1. The User is required to read these Terms and Conditions before concluding a contract for the provision of Services.
5.2. The contract for the provision of Services is concluded by:
5.2.1. in terms of enabling the conclusion of the Agreement with ITFF at a distance to purchase the Service referred to in Section. 4.1.1 of the Regulations – payment of the Fee and/or Subscription Fee.
5.2.2. In terms of free access to publicly available content on the Site, as referred to in Section. 4.1.2. Regulations – the start of use of the Service.
5.2.3. providing free access to the description of the Services in order to purchase access to them by Users referred to in Section. 4.1.3. Regulations – the start of use of the Service,
5.2.4. in the scope of making Trainers.org available to Trainers in order to enable them to present themselves and their offer of educational services to potential recipients of training services, together with the possibility of free familiarization of Users referred to in Section. 4.1.4 Terms and Conditions – entering into an agreement with the trainer, which specifies the scope and commencement of use of the Service.
5.2.5. Regarding the provision of the author’s accreditation path by ITFF under Trainers.org for a fee, referred to in point. 4.1.5 of the Regulations – payment of the Accreditation Fee.
5.2.6. In terms of free maintenance of User Accounts referred to in Section. 4.1.6. Regulations – User registration.
5.2.7. in the scope of free of charge, periodical delivery to Users, to the e-mail address provided by them, of a newsletter (information on ITFF activities and commercial information) (Newsletter Service), referred to in point. 4.1.7 of the Terms and Conditions – by the User voluntarily checking the appropriate box next to the content of such statement during the Registration or voluntarily completing the application for the service at www.trainers.org.
5.3. The contract for the provision of Services is concluded:
5.3.1. For the duration of the Service, i.e. until Trainers.org is closed in the web browser – for Services that do not require User Registration,
5.3.2. for the period of time for which the Subscription Fee has been paid by the Trainer – with respect to Services requiring payment of the Subscription Fee,
5.3.3. For the termination of the accreditation process – for the Accreditation Service,
5.3.4. for an indefinite period – in other cases.
6.1. Depending on the scope of the Service selected, the User may use Trainers.org without registration or requires registration.
6.2. Registration of an Account is made by filling out the registration form provided on Trainers.org. During Registration, it is necessary to provide the following data:
6.2.1. Title,
6.2.2. Name,
6.2.3. Name,
6.2.4. company name (optional),
6.2.5. TIN (in the case of a company),
6.2.6. phone number,
6.2.7. email address,
6.2.8. password,
6.2.9. repeat the password,
As well as marking the check buttons:
6.2.10. “I want to receive the newsletter,
6.2.11. “I agree to the Terms and Conditions.”
6.3. Registration of a User’s account does not require payment of a fee.
6.4. Provision of data in the registration process is completely voluntary, but necessary to complete the Registration.
6.5. The user is obliged to provide true data in the registration form and update it if it changes.
6.6. After submitting a properly completed registration form, the User will receive an email to the email address provided during Registration containing an activation link to the Account. Account Registration occurs when the user clicks on the activation link and is transferred to a sub-page with a user cockpit, allowing the user to manage their own profile on Trainers.org.
6.7. You will be able to access your Account by entering your login information. The login to the Account is the email address provided during Registration.
6.8. ITFF may block the account of a User / Trainer if there is a reasonable suspicion that he/she violates the provisions of these Regulations in any way.
6.9. Creating a new password is possible only with the help of the “I don’t remember my password” form available in the login panel.
6.10. ITFF allows you to log into your Account using your Facebook and Google accounts.
7.1. Users are obliged to use Trainers.org in accordance with applicable laws, rules of social coexistence, good morals, provisions of these Regulations and generally accepted rules of conduct on the Internet (Netiquette).
7.2. ITFF shall not be liable for the consequences of the User’s use of Trainers.org in a manner contrary to generally applicable laws, rules of social coexistence or these Regulations.
7.3. ITFF reserves the right to remove content from Trainers.org in the event that it is found to violate generally applicable laws, rules of social coexistence, decency, the provisions of these Terms of Service and generally accepted rules of conduct on the Internet (Netiquette), or there is a reasonable suspicion of such violations.
7.4. ITFF will make every effort to keep Trainers.org functioning continuously, but stipulates that there may be technical interruptions in the operation of Trainers.org due to the need for maintenance, modernization or servicing, as well as for other reasons beyond ITFF’s control (e.g., force majeure, act or omission of third parties for which ITFF is not responsible), of which it will inform the Users in a manner available to it and sufficiently in advance, if technically possible.
7.5. ITFF stipulates that materials made available on Trainers.org that do not originate from Users are copyrighted and thus protected by applicable copyright and related rights laws. Use of the content posted on Trainers.org does not imply acquisition by the User of any rights to the works or databases made available through Trainers.org.
7.6. ITFF is not responsible for the content published on Trainers.org by Users and Trainers, who are solely responsible for any violation of copyright or other laws.
7.7. The user is obliged to update the personal data he/she provided on Trainers.org in case it becomes outdated.
7.8. The user is obliged to keep his login, password confidential and to protect them from access by third parties.
7.9. Trainers.org resources may not be copied to the User’s computer or otherwise fixed by the User / Trainer , who does not own the copyright to them, without the prior written consent of the Trainers Organization. Exceptions are training materials that have been added to the Services for use and educational purposes.
8.1. As part of the Intermediary Service, Trainers can publish content about Trainers’ training through Trainers.org, in terms of e-learning resources and a blog.
8.2. Training content, in terms of e-learning resources and blog published on Trainers.org by the Trainer is self-edited by the Trainer and the Trainer is responsible for it. The ITFF, through Trainers.org, only provides the infrastructure and defines the content categories within it.
8.3. The trainer declares and undertakes that the publication of content in the field of e-learning resources and blog articles does not violate the rights of third parties .
8.4. If such content constitutes a work within the meaning of applicable copyright and related rights laws, Trainers declares that it owns the copyright or licenses to such content to the extent appropriate for its lawful publication on Trainers.org in accordance with the law and these Terms and Conditions.
8.5. By requesting publication of training content, in terms of e-learning resources and the blog, Trainers agree to their publication.
8.6. In any case, if the content constitutes a work within the meaning of copyright and related rights, through the publication of the above. content on Trainers.org, there is no transfer of copyright to ITFF, but the Trainer grants ITFF a non-exclusive, territorially and temporally unlimited license to use this work in the following fields of exploitation:
8.6.1. In terms of recording and reproduction of the work – production of copies of the work by a specific technique, including printing, reprography, magnetic recording and digital technique;
8.6.2. In terms of circulation of the original or copies on which the work was fixed – marketing, lending or renting of the original or copies, in particular on the Trainers.org portal and on Trainers.org social media profiles;
8.6.3. with respect to dissemination of the work in a manner other than specified in Section 8.6.2 – public performance, exhibition, display, reproduction, as well as broadcasting and re-broadcasting, as well as making the work available to the public in such a way that everyone can have access to it at a place and time of their own choosing.
8.7. The license referred to in item. 8.6 above, is granted as part of the Accreditation Fee upon publication of the work on Trainers.org.
8.8. The licensee may authorize others to use the work within the scope of the license obtained.
8.9. The trainer permits ITFF to exercise a dependent copyright on such work, i.e. in particular, to modify it, make abridgements and editorial changes in it, with the right to further grant such permission, as well as to incorporate content from Trainers.org into the work or to incorporate the work or parts of it into other works, without the author’s supervision of Trainers – to the extent described above. The Trainer further agrees to translate the training content, in terms of e-learning resources and testimonials, into languages other than the language in which the content is provided, in order to ensure that the site can be used by foreign language Users. The trainer agrees not to exercise moral copyrights in the work and authorizes ITFF to exercise them on his behalf.
8.10. ITFF reserves the right to moderate the blog and accept or reject them depending on the impossibility of their implementation, in particular for financial reasons and decisions of the team, lack of time by the team for implementation, incompatibility of statements with training and education and other legitimate reasons.
8.11. ITFF stipulates that all content presented on Trainers.org is the property of ITFF, partners with whom ITFF has entered into a separate agreement, or the persons who are the authors of the content (Trainers), and is subject to copyright protection, with the result that without prior written consent of authorized persons or entities, the User is not authorized to use such content in a manner that may violate any copyright.
8.12. Any additional functionality available to Users lasts for the period indicated in the description of the Service available prior to its acquisition, but no longer than the period specified in the description of the Service i.e. in the event that the User does not extend the validity period of the Account by paying the Subscription Fee, the additional functionalities purchased by that User will expire for a period longer than the period covered by the current Subscription Fee.
9.1. The execution of all payments under these Regulations shall be made through:

9.1.2. Stripe Service, in accordance with its terms and conditions available at https://stripe.com/en-pl/legal/ssa
9.1.3. Paypal service, in accordance with its terms and conditions available at https://www.paypal.com/webapps/mpp/ua/legalhub-full
10.1. A User wishing to delete his Account is required to send a request for deletion to ITFF electronically at info@trainers.srv45079.seohost.com.pl. Deletion of the account takes place immediately after receipt of the relevant notification and results in the irreversible deletion of the User’s personal data, provided that the login marked “deleted” remains in the database to prevent impersonation by others.
10.2. Deletion of the Account does not remove from Trainers.org the content added to the portal by the User whose Account is subject to deletion.
10.3. ITFF has the right to delete a User’s Account if he/she uses it for purposes that violate the law or the Regulations. ITFF will notify the User of the reasons for deletion of the Account by e-mail (to the address indicated by the User in the registration form).
11.1. Trainers.org is an educational, specialized service in fields related to didactics, train the trainers, facilitation, design thinking, ITFF will make every effort to ensure that the information on this site and from ITFF is provided correctly, but ITFF is not responsible for errors or any consequences arising from the use of the information on this site. With respect to content that does not originate from Trainers.org but from individual Users/Trainers, the individual Users/Trainers are responsible for such content.
11.2. ITFF shall not be liable to the User or any third party for any damages resulting from direct or indirect use of information or materials published on Trainers.org ITFF shall also not be liable for damages resulting from damage to the User’s computer equipment or other mobile devices or his/her data in connection with the use of Trainers.org, in particular as a result of computer viruses entering the User’s computer system.
11.3. ITFF shall not be liable for instances of Trainers.org unavailability occurring due to the failure of telecommunications communications, in particular, those on the part of the provider of Internet access, hosting services, and other consequences of the malfunctioning of telecommunications links and damage caused by them, regardless of the cause, unless caused intentionally by ITFF.
11.4. ITFF is not responsible for the actions and omissions of Users. It is also not responsible for infringement of personal rights or copyrights of third parties by Users or third parties.
11.5. ITFF and the information posted on the trainers.org platform in the Services, including, for example, online courses, may point to links to third-party sites and assumes no responsibility for the content on these sites. The posting of a link on the portal or in the Services by Trainers does not imply that ITFF recommends the site, products or services in question.
12.1. A user who is a Consumer is entitled to file a complaint on matters relating to the performance of the Services.
12.2. A complaint may be any objection or remark concerning the provision of the Services.
12.3. Complaints can be submitted:
12.3.1. By email to info@trainers.srv45079.seohost.com.pl,
12.3.2. In writing to the ITFF’s delivery address.
12.4. The complaint should include at least:
12.4.1. User’s name and contact information,
12.4.2. description of the event giving rise to the complaint,
12.4.3. The method of notifying the User about the method of processing the complaint.
12.5. Trainers Organization will consider the complaint within 30 days from the day the User submits the complaint. The ITFF will notify the User of the manner in which the complaint has been resolved in the manner indicated by the User in the notification of the complaint.
13.1. Users who are Consumers have the right to withdraw from the Service Agreement concluded with ITFF, without indicating a reason, within 14 days from the date of conclusion of such Agreement.
13.2. The statement of withdrawal from the Agreement may be made in writing, and in order to meet the deadline it is sufficient to send the statement to ITFF’s delivery address before the deadline. The declaration of withdrawal may also be submitted electronically, by sending it to ITFF at the e-mail address info@trainers.srv45079.seohost.com.pl.
13.3. The consumer may, but is not required to, use the template attached hereto as Exhibit 1 for the purpose of submitting a statement of withdrawal from the Service Agreement.
13.4. ITFF shall immediately send to the Consumer on a durable medium an acknowledgement of receipt of the notice of withdrawal submitted electronically.
13.5. ITFF may terminate your right to use Trainers.org, as well as may restrict your access to some or all of the resources or Services offered on Trainers.org, with immediate effect, in the event that Trainers.org violates these Terms of Use or applicable law.
14.1. Version of regulations: Regulations as of 1/10/2022.
14.2. ITFF reserves the right to amend the Regulations and update them.
14.3. If the ITFF changes the Regulations, it will notify Users.
14.4. The provision of the Services under these Regulations shall be governed by Polish law, which shall not deprive Consumers of their rights under the mandatory provisions of the law of the country of their permanent residence.
14.5. None of the provisions of the Regulations exclude or limit the rights of Users under applicable law.

1.9. RODO – Rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) (Dz.U.UE.L.2016.119.1)
1.10. Usługi – usługi świadczone Użytkownikom przez ITFF za pośrednictwem Trainers.org zgodnie z Regulaminem.
1.11. Użytkownik – oznacza osobę korzystającą z Trainers.org.
The following Privacy and Cookies Policy describes issues related to the processing of personal data and Users and the use of cookies in connection with the use of Trainers.org.
Cookies are small files sent by websites to your browser and stored on your device, such as a computer, cell phone, tablet. We enable the use of Google Maps to make it easier to find the towns and cities users specify on the site.
Trainers.org also uses social networks as part of making users’ use of the site more attractive. Login using a Google or Facebook account is available, as well as providing links to users’ social profiles within the trainer’s profile on the site. Thus, the Trainers.org platform uses cookies from sites such as Facebook, Twitter, Youtube, LinkedIn and Google.
Trainers.org provides the ability to use social features, such as sharing content on social networks. The use of these features involves the use of cookies of social network administrators such as Facebook, YouTube, Twitter, Google+, LinkedIN.
The site may contain links to other sites. For more information about cookies on third-party sites, please refer to their cookie policies.
The user can specify the conditions for storing cookies through browser settings.
In connection with the implementation of the Services, Users’ personal data will be disclosed to employees, associates and external entities to the extent necessary for the proper operation of Trainers.org and efficient service of the platform users, i.e. in particular:
The administrator will not transfer personal data to third countries or international organizations.
The period of data processing by the Administrator depends on the type of service provided and the purpose of the processing. As a general rule, data are processed for the duration of the Service, until the withdrawal of the consent given (in cases where processing is based on consent), or until an effective objection is made to the processing of data in cases where the legal basis for the processing is the legitimate interest of the Administrator.
The period of data processing may be extended if the processing is necessary for the establishment, investigation or defense against possible claims, and thereafter, only if and to the extent required by law. At the end of the processing period, the data is irreversibly deleted or anonymized.
The administrator shall make every effort to adequately secure the personal data provided and protect the privacy of users, in particular, against their access to unauthorized persons.
We reserve the right to change the Privacy and Cookies Policy by posting the new Privacy and Cookies Policy on Trainers.org.
At the same time, we will inform you through the newsletter or information on trainers.org.
